These Terms of Service govern the use of this website and the purchase of products from Smart Air Products Ltd, trading as Smart Air Products (“we”, “us”, “our”).

By using this website or placing an order, you agree to these Terms.

1. Who we sell to

We sell to customers in the United Kingdom only.

2. Products

All Smart Air Products products are made to order.

Product descriptions, specifications, dimensions, finishes and imagery are provided as accurately as possible. However:

  • product images are for illustrative purposes only
  • colours and finishes may vary slightly from how they appear on screen
  • all products are subject to availability of materials and manufacture

Unless expressly stated otherwise, products are supplied without handles.

Where stated on the product page, products are intended for professional installation.

3. Pricing

All prices shown on the website are in GBP (£). Smart Air Products Ltd is not VAT-registered, so VAT is not charged on website orders. 

If an obvious pricing error has occurred, we reserve the right not to accept the order.

4. Placing an order

When you place an order through our website, you are making an offer to purchase the selected product(s).

Receipt of an order confirmation email or payment acknowledgement does not mean that your order has been accepted.

All orders are subject to:

  • availability
  • review by us
  • acceptance by us

We reserve the right to reject or cancel an order before production begins, including where:

  • a product or material is unavailable
  • there is an error in pricing or product information
  • delivery is not feasible
  • we believe the order cannot be fulfilled as requested

If we cancel an order before production begins, we will refund any payment received for that order.

5. Order acceptance

Your order is accepted only when we confirm acceptance and/or begin processing the order for manufacture.

Once production has commenced, cancellations or specification changes may not be possible, except where required by law. Please see our Refund Policy for further details.

6. Made-to-order products

All products are manufactured to the customer’s selected specification.

As these are made-to-order goods:

  • returns for change of mind are not accepted
  • exchanges are not offered
  • cancellations or specification changes may not be possible once production has commenced

Nothing in these Terms affects your legal rights if goods are faulty, damaged, or not as described.

7. Payment

Payment for website orders is taken in full at checkout unless otherwise agreed by us in writing.

Alternative ordering methods, including manual quotations or invoices, may be agreed separately. Where we issue a quotation or invoice directly, payment terms will be as stated on that quotation or invoice. Production will not begin until payment has been received in full.

8. Delivery

Delivery information, charges and requirements are set out in our Shipping Policy, which forms part of these Terms.

In summary:

  • products are made to order and dispatched when ready
  • delivery is mainland UK only, excluding Northern Ireland
  • standard delivery is charged at a flat rate of £150, unless a separate delivery quote is required
  • delivery is threshold only
  • the customer is responsible for ensuring suitable access and appropriate unloading arrangements

Risk in the goods passes to you when the goods are delivered to you or to a person identified by you to take possession of them.

9. Inspection on delivery

You should inspect the goods upon delivery and notify us as soon as reasonably possible if:

  • the goods are damaged
  • the goods are defective
  • the wrong goods have been supplied

10. Product suitability and installation

It is the customer’s responsibility to ensure that the product selected is suitable for the intended project, space and installation environment.

The customer is also responsible for checking all relevant dimensions, access routes, and product specifications before ordering.

Where products are stated to require professional installation, they should be installed only by a competent professional.

11. Website content

We try to ensure that all information on this website is accurate and up to date. However, we do not guarantee that all content will always be free from typographical errors, omissions, or inaccuracies.

We reserve the right to update, amend, or remove product information, prices, specifications, and website content at any time without notice.

12. Limitation of liability

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, including liability for fraud or fraudulent misrepresentation, or your statutory rights as a consumer.

Subject to the above, we shall not be liable for any indirect or consequential loss arising out of or in connection with the supply of goods or use of this website.

Our liability to you in relation to any order shall not affect your legal rights in relation to faulty, damaged, or misdescribed goods.

13. Consumer rights

Nothing in these Terms, our Shipping Policy, or our Refund Policy affects your statutory rights under applicable consumer law.

14. Governing law

These Terms are governed by the laws of England and Wales.

If you are a consumer, you may bring legal proceedings in the courts of the part of the United Kingdom in which you live, where applicable.
